Sulphur Police Officer Faces Felony Child Neglect Charge

Charge Filed After Officer Allegedly Allows Sex Offender To Stay In Her Davis Home

A Sulphur police officer was charged December 10 with felony child neglect after allegedly allowing a non-registered sex offender to stay at her residence occupied by a four-year-old child.

The information was outlined in a probable cause affidavit and charging documents filed in Murray County District Court last week against Nicole Shultz.

Shultz, 31, was released from custody after posting bond.

According to the affidavit, the charge arose after a call to emergency services on December 3 made Davis Police aware a non-registered sex offender was allegedly staying at a residence near Fullerton Park in Davis.

The affidavit indicated that the residence was occupied by Shultz, who admitted to a witness the man living there was a registered sex offender, but denied that fact when questioned by officers.

Davis Police detective, Seth Kemper, said in the affidavit he was informed of the alleged living arrangement on December 3, and launched an investigation on December 6. Kemper also confirmed the identity of the man living in the residence as Colby Kile, an aggravated sex offender.

Kemper said in the affidavit he contacted the Sulphur Police Department where Shultz worked as an officer and updated them on his investigation.

According to the affidavit, Kemper said he spoke to Shultz on Monday, Dec. 9 after she waived her Miranda Rights, and told him she “did not look up his history because she felt that would be an abuse of power as a law enforcement officer.”

The Sulphur officer was arrested after that conversation and taken to the Murray County Jail for book-in procedures. Davis office Maddison Hatley assisted during the interrogation of Shultz, according to the affidavit.

Also, according to the affidavit, charges are expected to be filed against Kile for failing to register as a sex offender through the Chickasaw Nation District Court.

Kemper said in the affidavit the Department of Human Services (DHS) was contacted about the child living in the home and that the child has since been removed from the residence and is safe.

Shultz is set to appear for a preliminary hearing conference at 9:00 a.m. on January 9 in Murray County District Court.
